The Delivery Group Pty Ltd trading as Sparky Stock (ABN 84 700 390 932) respects your privacy. This policy explains how we handle personal information when you visit sparkystock.com.au, buy from us, subscribe to our updates, contact us or submit a job enquiry.

We handle personal information in accordance with the Australian laws that apply to our activities, including the Privacy Act 1988 (Cth) and Australian Privacy Principles where applicable, and the Spam Act 2003 (Cth). This policy does not limit any legal rights you have.

1. Information we collect and hold

The information we handle depends on your interaction with Sparky Stock and can include:

  • Identity and contact details: your name, email address, telephone number, billing and delivery addresses, and business name or ABN where provided.
  • Orders and accounts: products purchased, order numbers, prices, payment and refund status, transaction references, delivery instructions, account identifiers and order history.
  • Customer support: enquiries, correspondence, return and warranty records, product serial numbers, photographs and relevant installation details you provide.
  • Marketing preferences: newsletter subscriptions, consent records and unsubscribe choices.
  • Website activity: IP address, approximate location inferred from it, device and browser information, cookie identifiers, pages and products viewed, searches, cart activity and interactions with website features.
  • Job enquiries: contact details, employment history, qualifications, resumes and other information you choose to submit when applying for work.

We seek only information reasonably needed for the relevant purpose. Please avoid sending sensitive information, identity documents or complete card details unless we have explained why they are necessary and how to provide them securely. If sensitive information is needed, we will obtain consent where required or rely on another lawful basis.

2. How information is collected

We collect information directly when you place an order, create or use an account, complete a website form, subscribe to our newsletter, email us or otherwise communicate with us. Website technologies also collect information when your browser interacts with our store and its service providers.

We can receive related information from Shopify, payment providers, delivery companies and connected marketplaces, such as payment status, delivery updates and order details needed to fulfil a purchase. If you buy from us through a linked marketplace, that marketplace and Shopify Marketplace Connect can pass the necessary customer and order information to our store.

If you give us another person's details, such as a delivery recipient or referee, please ensure you are authorised to do so and let them know about this policy.

3. Why we use personal information

We use information to process payments and orders, arrange delivery, manage accounts, answer enquiries, handle returns and warranty claims, and communicate about these matters. We also use relevant information to protect against fraud, administer and improve the store, maintain transaction records and meet legal obligations.

Marketing information is used to send the updates you have agreed to receive and manage your preferences. Website activity helps us understand how our store is used, improve its content and assess advertising performance where those features are used. Recruitment information is used to assess and respond to job enquiries.

We will seek any further consent required by law before using information for another purpose that is not otherwise permitted.

4. Your choice to provide information

You can browse public pages and make general enquiries without identifying yourself, or use a different name where practicable and lawful. Technical information may still be collected during browsing.

We need sufficient contact, payment and delivery information to process an order or resolve an enquiry. If you do not provide necessary information, we may be unable to complete that service. Optional marketing consent is not a condition of buying from Sparky Stock.

5. Shopify and connected services

Shopify hosts our online store. When you visit or buy from us, information is shared with Shopify to operate the website, checkout, accounts, order processing and related services. Shopify also processes certain information for its own purposes as described in its Consumer Privacy Policy.

Some Shopify services can use information about interactions with our store, other merchants and Shopify to provide and improve services, personalise experiences and support advertising. This depends on the services enabled and applicable privacy choices. Shopify explains its processing and available controls through its privacy portal.

Other services connected to Sparky Stock include:

  • ShipStation: shipping software that can receive order, recipient and delivery details when used to arrange or manage a shipment.
  • Shopify Marketplace Connect: synchronises information needed to manage orders from connected marketplaces.
  • Shopify Messaging: supports customer communications and marketing sent with the required consent.
  • Afterpay: our site includes Afterpay payment messaging. Its embedded features can receive browser and interaction information when loaded. If you choose Afterpay at checkout, relevant order, contact and payment information is handled to provide that service. See Afterpay's Australian Privacy Policy.

Payment providers collect the information needed for the payment method you select and provide us with transaction status and related records. We do not intentionally retain complete payment-card details when payments are processed by a payment provider. Please do not send card numbers or security codes through our contact form or email.

6. Who else receives information

Where necessary for the purposes described above, we share relevant information with:

  • Authorised staff and contractors who administer the store or assist with customer enquiries;
  • Payment processors, banks, shipping software providers, couriers and freight companies;
  • Suppliers or manufacturers assisting with a product enquiry, return or warranty claim;
  • Technology providers supporting hosting, email, business administration, security, analytics and advertising;
  • Professional advisers, including accountants and lawyers; and
  • Regulators, courts or other authorities where disclosure is required or authorised by law.

We limit disclosures to information relevant to the service or lawful purpose. We do not sell or rent customer contact lists. Service-provider and advertising-related disclosures are described in this policy; those providers may have their own responsibilities for information they process.

For example, a courier may need your name, delivery address and phone number, while a manufacturer assessing a warranty may need product details and the information relevant to the fault.

7. Cookies, analytics and advertising

Our store and embedded services use cookies and similar technologies for functions such as maintaining a cart, account access, remembering choices, security and understanding website use. Analytics and advertising technologies, where used, can record browsing events, identifiers and interactions to measure campaigns or personalise content and advertising.

You can manage cookies through your browser. Blocking some cookies may affect checkout or other functions. Where a cookie preference panel is available, you can also use it to adjust the choices it offers. Your browser settings do not necessarily control all server-side processing or information already collected.

Where consent is legally required for a technology or use of information, it must be obtained before that processing occurs. Simply visiting the website does not replace consent required by law. You can contact us about privacy preferences or use the relevant provider's controls, including Shopify's privacy portal.

8. Marketing and unsubscribing

We send promotional emails or text messages only with consent that is valid under Australian law. This can include subscribing to our newsletter or otherwise agreeing to receive updates. A purchase or general enquiry alone is not treated as automatic consent to marketing.

You can unsubscribe using the instructions in a message or by contacting sales@sparkystock.com.au. We will stop the relevant marketing within 5 working days of your request. We do not charge an unsubscribe fee or require you to create or log in to an account to unsubscribe.

You can still receive necessary non-promotional messages about an order, delivery, refund, security issue or enquiry. We may retain a limited record of your opt-out so that we can honour it.

9. Overseas handling of information

Our use of global service providers means personal information may be transferred, stored or accessed outside Australia.

Shopify identifies core group recipients in Canada, the United States, Ireland and Singapore, together with other group and service-provider locations listed in its current subprocessor information. The recipients involved depend on the services used. ShipStation's provider, Auctane, also identifies the United States as a likely overseas location in its Australian privacy information.

Payment, messaging and other technology providers may use additional overseas recipients according to the service selected. Relevant provider information includes Shopify's Privacy Policy, Auctane's Privacy Policy and Australian addendum, and Afterpay's Australian Privacy Policy. Contact us if you need further information about a particular service.

Where Australian law requires safeguards for an overseas disclosure, we will take the required reasonable steps. This policy does not ask you to waive Australian privacy protections or treat website use as consent to waive them.

10. Storage, security and retention

Personal information is held in Shopify and the business systems used to manage orders, email, delivery and customer support, and in any related business records. We take reasonable technical and organisational steps to protect it against loss, interference, misuse and unauthorised access, alteration or disclosure. Access should be limited to people and providers who need it for their work.

We retain information only for as long as needed for a permitted purpose, including completing orders, handling claims, maintaining necessary business records and complying with retention obligations. Different records can require different retention periods.

When information is no longer needed and does not have to be kept under law or a court or tribunal order, we take reasonable steps to securely destroy it or de-identify it, including information held for us by service providers. No online system can guarantee absolute security; this does not remove our legal responsibilities.

11. Access, correction and deletion requests

You can ask to access the personal information we hold about you, or request correction of information that is inaccurate, outdated, incomplete, irrelevant or misleading. Email us or use our Contact Us page. No special form is required.

We may reasonably verify your identity or a representative's authority. We aim to respond within 30 days, and will explain any delay. There is no charge to make a request or to correct information. If a lawful, reasonable charge is proposed for providing access, we will explain it beforehand.

If we cannot provide access or make a requested correction, we will explain the lawful reason and how to complain. Where applicable, you can ask us to associate a statement of your disagreement with the record, or notify another recipient of a correction.

You can also ask us to delete information or close your account. We will consider the request and explain any information that must be retained. Account closure or deletion of an online profile does not necessarily erase order, tax, dispute or other records we must lawfully keep.

12. Privacy concerns and complaints

Contact sales@sparkystock.com.au, addressed to the person responsible for privacy, with a description of the concern and the outcome you would like. You may use our contact form or ask for help making your complaint.

We will acknowledge and investigate the complaint, review relevant records, seek further information where needed and explain our response. We aim to provide a substantive response within 30 days and will keep you informed if more time is needed.

If you are dissatisfied with the response, or do not receive one within 30 days, you may complain to the Office of the Australian Information Commissioner (OAIC) where it has jurisdiction. Concerns about unsolicited electronic marketing can also be raised with the Australian Communications and Media Authority.

13. Data breaches

If we become aware of a security incident involving personal information, we will investigate, take steps to contain it and assess the risk to affected people.

Where the Notifiable Data Breaches scheme applies and an eligible breach occurs, we will notify the OAIC and affected individuals as required, including advice on protective steps. An eligible breach generally involves unauthorised access, disclosure or loss likely to cause serious harm that remedial action has not prevented. Please contact us promptly if you suspect an issue involving your information.

14. Other websites, children and policy changes

Third-party websites, marketplaces and payment services have their own privacy policies. Please review them when using those services. This does not remove our responsibility for information we disclose.

Our store is intended for a general retail and trade audience and is not directed at children. If a child has provided information that is unnecessary for a lawful service, a parent or guardian can contact us to discuss its handling.

We will update this policy as our practices or legal requirements change and show the revised date. Where a change requires a separate notice or consent, we will provide that notice or obtain that consent. You can ask us for a free copy of this policy or help accessing it in another form.
